Labour market: Employment regulations - Foreign workers

As Poland joined EU in 2004, the legal requirements for foreign employees intending to commence working in Poland differ, depending whether the particular individual is the EU national or citizen of the third country.

Procedures required to employ a foreign employee in Poland are shown in the table below:

  • Registering of the EU national's residence in the Voivod's Office according to the place of the EU national's actual stay in Poland during 3 months after arrival.
The process consists of 4 main stages:
  • obtaining the opinion from the local labour authorities and public announcement on the vacancy – the main aim of those procedures is to verify whether there are no Poles having the required skills and wishing to undertake the position offered by the employer;
  • obtaining the preliminary work permit;
  • applying for a document legalizing the foreign national stay in Poland (this can be either a work visa or a residence permit);
  • obtaining a final work permit (for a period up to 1 year).
The entire process may take in practice 3 months.
